Serving legal process in Latvia

Latvia acceded to the Hague Service Convention on March 28, 1995, with entry into force on November 1, 1995, and Latvia's position on Article 10 is unusually precise. Postal service under Article 10(a) is permitted, but only if the documents are translated into Latvian and sent by registered postal letter with acknowledgment of receipt — an explicit condition rarely spelled out this specifically by other signatories. Article 10(b) is fully opposed. Article 10(c) direct service by a case participant is allowed only with a Latvian judge's consent, and only if the destination country hasn't itself objected to that method.

Frequently Asked Questions: Serving Process in Latvia

Can documents be served in Latvia by mail?

Yes, but only under specific conditions: the documents must be translated into Latvian and delivered by registered postal letter with acknowledgment of receipt. Mail service that doesn't meet both conditions is not valid.

Can a foreign judicial officer serve documents directly in Latvia?

No. Latvia has fully opposed Article 10(b), the direct judicial-officer-to-judicial-officer service method.

Can a case participant serve documents directly under Article 10(c)?

Only with a Latvian judge's specific consent, and only where the recipient country hasn't itself objected to that method — a more conditional position than a simple yes or no.

When did Latvia join the Hague Service Convention?

Latvia acceded on March 28, 1995, with entry into force on November 1, 1995.

Is translation always required?

For the conditional postal route, yes, Latvian translation is a hard requirement. For Central Authority service, translation requirements should be confirmed for the specific filing.
