Serving legal process in the Republic of Kenya

Kenya has not joined the Hague Service Convention, and its record on international civil cooperation treaties more broadly remains limited — Kenya has also not yet ratified the Hague Child Abduction Convention. Inbound letters of request for service in Kenya are governed by Order 5, Rule 32 of Kenya's Civil Procedure Rules: the request must be accompanied by an English translation and two copies of the process, and the High Court executes service according to its own rules and practice for serving individuals within Kenya.

01

High Court Letter of Request Filing

We prepare a letter of request compliant with Order 5, Rule 32 of Kenya's Civil Procedure Rules, including the required English translation and duplicate copies of process, and submit it to the Kenyan High Court.

02

Local Agent Service via Kenyan Counsel

We engage local Kenyan counsel to effect service or advise on the fastest compliant method given Kenya's non-Hague status.

Diplomatic Letters Rogatory

For matters requiring a more formal, treaty-independent channel, we prepare Letters Rogatory routed through diplomatic channels between the U.S. and Kenyan judicial authorities.

Frequently Asked Questions: Serving Process in Kenya

Is Kenya a signatory to the Hague Service Convention?

No. Kenya has not joined the Convention, so service relies on formal letters of request to the Kenyan High Court or diplomatic Letters Rogatory.

What rule governs inbound letters of request in Kenya?

Order 5, Rule 32 of Kenya's Civil Procedure Rules, which requires the letter of request to be accompanied by an English translation and two copies of the process to be served.

Who executes service once a request reaches Kenya?

The High Court of Kenya executes service in accordance with its own rules and practice governing service to persons within its jurisdiction.

Is translation required?

Yes. Requests and accompanying process must be provided in English, or accompanied by an English translation, under Order 5, Rule 32.

Does Kenya's non-Hague status extend to other Hague conventions?

Yes, broadly. Kenya has also not yet ratified the Hague Child Abduction Convention, though its Cabinet approved accession to that separate convention in 2023, pending Parliamentary review.
