Serving legal process in the Kingdom of the Netherlands

Fittingly, the country that hosts the Hague Conference itself has not objected to the Article 10 alternative channels, so both postal service and direct service by a Dutch bailiff (gerechtsdeurwaarder) are valid alongside the formal Central Authority route. For documents to be served in the Court District of The Hague, the Central Authority assigns a randomly selected bailiff directly; for other districts, the request routes through the relevant Public Prosecutor's Office or International Legal Assistance Center, which then engages a bailiff for execution.

01

Bailiff (Deurwaarder) Direct Service

Since the Netherlands has not objected to Article 10(b), a Dutch bailiff can serve documents directly, including leaving a sealed copy at the defendant's residence under Article 47 of the Dutch Code of Civil Procedure when personal service isn't possible.

For the formal treaty channel, we submit requests through the Dutch Central Authority, which assigns a bailiff directly for The Hague district or routes through the Public Prosecutor's Office / International Legal Assistance Center for other districts.

Frequently Asked Questions: Serving Process in Netherlands

Can documents be served in the Netherlands by mail or a bailiff directly?

Yes. The Netherlands has not objected to Article 10(a) or 10(b), so postal service and direct service by a Dutch bailiff (gerechtsdeurwaarder) are both valid alongside the formal Central Authority channel.

What happens if the Central Authority handles a request outside The Hague?

The Central Authority forwards it to the designated Public Prosecutor's Office or International Legal Assistance Center (IRC) for that court district, which then requests execution by a local bailiff.

What language can filings be submitted in?

The Dutch Central Authority may receive and process documents in Dutch or English, simplifying preparation for English-language U.S. filings compared to countries requiring full certified translation.

What happens if personal service isn't possible?

Under Article 47 of the Dutch Code of Civil Procedure, a bailiff may leave a copy of the documents in a sealed envelope at the defendant's residence if personal service cannot be completed.

Is it a coincidence that the Netherlands hosts the Hague Convention's administering body?

The Hague Conference on Private International Law, which drafted the Convention, is headquartered in The Hague — the same city where the Dutch Central Authority for The Hague district assigns bailiffs for incoming requests.
